The effect of the legislative development on the organization and jurisdiction of the Jordanian administrative judiciary

Abstract


The judiciary control represents a real guarantee for the work of the administration, rights, public freedoms, and an effective protection of the legitimacy principle, through which the significance of current study stems. The research problem is embodied in the Jordanian administrative judiciary control is Limited to Examining the legality of the appealed administrative decision, Cassation it, and compensate for it, in the event that it is unlawfully judged only, It does not extend to the settlement of other administrative disputes. In order to clarify the importance, problem and limitations of the effect of the legislative development on the organization and jurisdiction of the Jordanian administrative judiciary; the comparative descriptive analytical method was followed in researching its topics which organizing the Administrative judiciary, and its jurisdiction. Among the most important results the current study has reached that the judicial system in Jordan is based on partial bilateral supervision, since the judicial control of the administration’s work, is once a matter of administrative jurisdiction, and of the jurisdiction of the ordinary judiciary in other cases. The current study has recommended that the legislator needs to interfere in stating to establish an independent state council that consists of two parts; Judicial section specialized in viewing all administrative disputes, and an administrative section, concerned with drafting legislation, providing fatwas and legal opinions.
