The Condition of the Secondary Case in Analogy in the Fundamentalists’ Point of View

This paper aims at studying the conditions of the secondary case, which is one of the fundamentals of analogy. The scholar examines the evidence in order to deduce Islamic rules. The paper falls into two sections: conditions agreed upon by predecessors and controversial conditions. These conditions are recurrent both in the secondary case and the other basics of analogy: the cause and the rule of the primary case’s rule. The paper concludes with a fundamental condition that must not be stated in the holy Koranic text or Hadith, the rest of the conditions are to be attached with the cause, the primary case or its rule.
